Terms and Conditions

1. Introductory provisions
1.1. These Terms and Conditions regulate and define the mutual rights and obligations between Burica, a sole proprietorship for services and trading, registered in the Trade Register under MB: 99059177, represented by the owner Antonia de Castro Burica, OIB: 30137287200 (hereinafter: Burica), as the organizer and provider of language courses, on one side, and the service user (course participant), on the other side.
1.2. The service user (hereinafter: User) is any legal or natural person who has entered into a service contract with Burica for services offered by Burica through promotional materials, the website, etc. For the purposes of these Terms and Conditions, the terms User and Participant are equivalent.

2. Definition of terms
2.1. A Group Course is a course held online (virtual classroom) at prearranged and fixed times. Absence from a group course cannot be compensated, except at the request of the Participant, at an agreed time, and with an agreed additional fee.
2.2. An Private Course (per module) is a course held online (virtual classroom) on a one-to-one basis with the Participant, at a schedule agreed in advance. Any absence must be reported at least 24h in advance; otherwise, the lesson will be considered as held, except in the case of sudden illness proven by a medical certificate of incapacity for work or another relevant medical document.
2.3. An Private Course (per hour) is a course held online (virtual classroom) on a one-to-one basis with the Participant, at a schedule agreed in advance. Any absence must be reported at least 24h in advance; otherwise, the lesson will be considered as held, except in the case of sudden illness proven by a medical certificate of incapacity for work or another relevant medical document.
2.4. An Private Conversational Course is held online (virtual classroom) on a one-to-one basis with the Participant, at times agreed in advance. Any absence must be reported at least 24h in advance; otherwise, the lesson will be considered as held, except in the case of sudden illness proven by a medical certificate of incapacity for work or another relevant medical document.
2.5. A Final Exam is a written and/or oral assessment within a group course, testing the Participant’s language knowledge. Upon successful completion, Burica issues a certificate in Croatian and, upon request, in the target language.
2.6. An Exam Session is a scheduled date within the course during which the final exam (oral and/or written) for a certain level is held. If a Participant does not attend an exam session that was included and covered in the course price, each subsequent attempt will be charged according to Burica’s Price List.
3. Rights and obligations of the User
3.1. The User must sign a course attendance contract with Burica and pay the full agreed course fee.
3.2. If the User’s behavior prevents or significantly disrupts classes, thereby causing damage to Burica, the User must compensate for such damage.
3.3. The User has no right to choose teachers for group or individual courses, nor to organize the teaching schedule or allocate teachers within groups.
3.4. For individual courses, the class times are agreed directly with the User.
4. Rights and obligations of Burica
4.1. Burica must enable the User to attend the course at the agreed time. If, for justified reasons, a course session cannot take place, Burica undertakes to deliver the remaining lessons in accordance with a feasible schedule.
4.2. If, prior to the start of a group course, the minimum number of Participants required by Burica for that course is not met, Burica has the right to terminate the contract. In that case, the User will be refunded. Instead of termination, Burica may organize a differently structured course (different number of lessons, price, or start date), provided the User is duly informed. Any change leading to a price increase requires the User’s consent.
4.3. Burica guarantees that all teachers possess the necessary qualifications, knowledge, and skills required for quality teaching.
5. Course delivery
5.1. Burica provides the teaching space (virtual classroom) with all technical prerequisites and content necessary for smooth and quality course delivery, as well as one teacher per group, individual, or conversational course.
5.2. The teaching space refers to a virtual classroom. Virtual classrooms are organized using remote communication tools (hereinafter: Online Teaching). Online Teaching is conducted via the Google Meet platform or other appropriate platforms ensuring smooth course delivery.
5.3. To participate successfully, the User must have a stable internet connection and an active e-mail address. Before classes begin, the User may be asked to consent to joining a WhatsApp group (for group courses) for easier communication.
5.4. If a Participant of a Group Course is unable to establish a stable internet connection at the agreed schedule, the session will not be postponed and will proceed as scheduled.
5.5. By signing the contract, the User confirms that they meet all technical requirements necessary for Online Teaching.
6. Payment
6.1. The User fulfills their contractual obligation by paying the agreed fee.
6.2. Payment can be made in full or in installments, as specified in the Price List.
6.3. Payment can be made via bank transfer slip or online banking.
6.4. For installment payments, each installment is due by the 10th of the month.
6.5. The full fee for a group course, individual course per module, or conversation course must be paid at least 5 days before the start of the course, unless installment payment has been agreed.
6.6. Burica may suspend a User from the course if payment is delayed by more than 30 days, until all overdue amounts are paid.
6.7. For an Private Course (per hour), the User must pay at least 2 days before the next scheduled lesson. Otherwise, Burica reserves the right not to deliver the scheduled lessons.
6.8. To reserve a place in a Group Course, a deposit of €80 must be paid at least 10 days before the start, regardless of whether the course is paid in full or in installments. In case of cancellation by the User, the deposit is non-refundable.
7. Termination of contract
7.1. The User has no right to terminate the contract if Burica has fulfilled its service and the provision of the service began with the explicit prior consent of the User.
7.2. If the service has only been partially fulfilled, the User must pay a proportionate fee for the completed part.
8. Intellectual property and personal data
8.1. Burica holds exclusive copyright to all independently created materials, written exercises, exercise concepts, collections of tasks, etc.
8.2. Exam materials constitute Burica’s copyrighted work. The User is liable for any infringement, such as unauthorized distribution of exams.
8.3. In accordance with Article 2 of the Personal Data Protection Act, the User agrees that Burica may collect their personal data (name, surname, email address, place of birth, occupation, phone number, etc.), as well as exam performance data, exclusively for analysis, maintaining participant records, informing about new services, and other legally permitted purposes. 8.4. The User agrees that taking photographs by Burica, for the purposes of promotion and advertising, does not constitute a breach of contractual obligations, and consents to the publication and/or distribution of such photographs in official bulletins, brochures, etc.
9. Final provisions
9.1. Burica reserves the right to amend and/or supplement these Terms and Conditions at any time, with Users being notified by publication on the official website.
